REGULATIONS FOR THE PROVISION OF ELECTRONIC SERVICES ("ŚUDE REGULATIONS")

General Provisions § 1

  1. These regulations constitute the regulations referred to in Article 8 of the Act of July 18, 2002, on the provision of electronic services, in connection with the provision of electronic services described in these Regulations.
  2. The Regulations define the type and scope of services provided electronically by the service provider, the conditions of their provision, as well as the rules for concluding and terminating distance service agreements and the complaint procedure.

Definitions § 2

  1. Email Address – The email address used by the service recipient.
  2. Cookies – Information in the form of small text files stored on electronic communication devices by a server. They allow the server to read information each time a connection is made with a specific electronic communication device. Details on the operation of cookies are included in our privacy policy.
  3. Telecommunications Law – The Act of July 16, 2004, Telecommunications Law.
  4. GDPR – Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, on the protection of natural persons regarding the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation).
  5. Website – The website managed by Piemontesp. z o.o., based in Warsaw, at Wioślarska 8, 00-411 Warsaw.
  6. Agreement – An agreement for the provision of electronic services concluded between the service provider and the service recipient under the terms set out in these Regulations, automatically entered into upon the use of the Service.
  7. Services – Free services provided remotely, without the simultaneous presence of the parties, through data transmission at the individual request of the service recipient, sent and received using digital compression and data storage, transmitted via a telecommunications network. These include, in particular:
  8. An electronic form allowing the service recipient to submit a question (contact form),
  9. An electronic form allowing the service recipient to provide an email address for receiving commercial information (newsletter form),
  10. An electronic form allowing the service recipient to order a service or make a reservation (reservation form).
  11. Service Recipient – A natural person using an electronic service under the terms set out in the Regulations.
  12. Service Provider – The entity providing electronic services, i.e., Piemontesp. z o.o., based in Warsaw, Wioślarska 8, 00-411 Warsaw, registered in the National Court Register of Entrepreneurs maintained by the District Court for the capital city of Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000877696, with a share capital of 5,000.00 PLN, REGON 387925689, NIP 7011013205.
  13. E-Services Act – The Act of July 18, 2002, on the provision of electronic services.

Services § 3

  1. The Service Provider provides the Services for an indefinite period using a telecommunications system.
  2. The Agreement is concluded by completing an electronic form referred to in § 2(7) and submitting its content to the Service Provider.
  3. Ordering the Services by the Service Recipient constitutes acceptance of these Regulations.
  4. The Service Recipient may use the Services provided they meet the technical requirements specified in § 4 of the Regulations.

Technical Requirements for Using the Services § 4

  1. The use of Services is possible provided that the IT system used by the Service Recipient meets the following minimum technical requirements:
  2. A device capable of transmitting telecommunication data;Internet access;
  3. An email address;
  4. The latest version of Chrome™, Firefox™, Internet Explorer™, Opera™, or Safari™ with JavaScript enabled.
  5. The Service Provider is not responsible for any technical issues or limitations of the Service Recipient that may prevent them from using the Services.

Withdrawal from the Agreement § 5

  1. The Service Recipient has the right to withdraw from the Agreement at any time without providing any reason.
  2. To exercise the right to withdraw, the Service Recipient must notify the Service Provider of their decision through an unequivocal statement via any communication channel.
  3. The Service Provider has the right to terminate the agreement with seven days' notice for valid reasons, including:
  4. Changes in laws regulating the provision of Services affecting the rights and obligations outlined in the Agreement;
  5. Changes in the interpretation of these legal provisions due to court rulings, decisions, recommendations, or guidelines issued by relevant authorities;
  6. Technical or technological changes affecting the manner of providing Services;
  7. Changes in the scope or manner of providing Services, including modifications or withdrawal of current functionalities.
  8. The Service Provider has the right to immediately terminate the agreement or refuse to provide Services in the event of gross violations of the Regulations by the Service Recipient, specifically in cases of violations of § 6(3) or § 6(4) of the Regulations.

Rights and Obligations of the Parties § 6

  1. The Service Provider is not responsible for service interruptions due to circumstances beyond their control.
  2. The Service Recipient has the right to file a complaint under the provisions of § 7.
  3. The Service Recipient must use the Services lawfully and respect the rights of the Service Provider and third parties, including intellectual property rights.
  4. The Service Recipient is prohibited from:
  5. Distributing illegal content, including content that promotes violence or infringes on personal rights;
  6. Interfering with the proper functioning of the Services;
  7. Violating Polish law, these Regulations, or general principles of internet use.

Complaints § 7

  1. The Service Provider strives to ensure proper service delivery and commits to resolving technical issues reported by the Service Recipients in a timely manner.
  2. Service-related complaints should be submitted through any available communication channel.
  3. The Service Provider will respond to complaints within 30 days of receipt.

Final Provisions § 8

  1. The Service Provider reserves the right to amend these Regulations for important reasons, including:
  2. Compliance with changes in laws or regulations;
  3. Improved service delivery;Introduction of new Services or functionalities;
  4. Technical updates or corrections.
  5. Changes to the Regulations take effect 14 days after notice is given. The Service Recipient may terminate the Agreement within this period if they do not accept the changes.
  6. The Service Provider holds exclusive rights to all content published under these Regulations, and Service Recipients may only use such content for personal purposes unless express permission is granted in writing.
  7. These Terms & Conditions are subject to updates and modifications as necessary.
